1.            These terms

1.1          What these terms cover. These are the terms and conditions on which we supply services.

1.2          Why you should read them. Please read these terms carefully before you submit your reservation. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

2.            Information about us and how to contact us

2.1          Who we are. We are Charlie, Julia and Joanna Hutchings. We are a partnership trading as Larkbeare Grange. Our address is Larkbeare Grange, Talaton, Exeter, Devon, EX5 2RY.

2.2          How to contact us. You can contact us by using any of the details contained on our Contact Us page.

2.3          How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when making your reservation.

2.4          "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes email but not fax.

3.            Our contract with you

3.1          How to place your reservation. You can place a reservation online via our website (www.larkbeare.net) or by contacting us using the details available on our Contact Us page.

3.2          How we will accept your reservation. Our acceptance of your reservation will take place when we email you to accept it, at which point we will ask for a non-refundable deposit after which a contract will come into existence between you and us.

3.3          If we cannot accept your reservation. If we are unable to accept your reservation, we will inform you of this in writing and will not charge you. No contract will be formed between you and us in this circumstance.

4.            Your reservation

4.1          Arrival date and Departure. We will confirm your arrival and departure time and date in our confirmation email when we accept your reservation. Please note that we detail our opening times on the Accommodation page of our website, should you require access to Larkbeare Grange outside these times, please Contact Us.

4.2          You must adhere to the property rules. There are property specific rules in place for Larkbeare Grange that you must adhere to. These rules are outlined on the Accommodation page of our website. 

4.3          Information regarding the local area. Any information regarding the local area that may be shown on our Website is outside our control and is not supplied by us. Whilst we endeavour to keep this information up to date we cannot guarantee that it is accurate.

4.4          Internet availability. Wireless internet access is offered without additional charge for residents on the basis that we cannot promise that the service will be available constantly and that it is provided for recreational and not for business use. Neither a minimum speed, unrestricted bandwidth nor uninterrupted provision of an internet access service can be guaranteed. We will not be liable for any claim in respect of the provision of internet services or telephone services not being available or failing.

5.            Your rights to make changes

To make changes to your reservation. If you wish to make a change to the reservation you have placed please contact us. We will let you know if the change is possible. If it is possible, we will let you know about any changes to the price of the reservation or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change, or the consequences of making the change are unacceptable to you, you may want to end the contract.

6.            Price and payment

6.1          Where to find the price for the reservation. The price of the reservation (including VAT where applicable) will be the price indicated on our Accommodation page of our website. We take all reasonable care to ensure that the price of the accommodation advised to you is correct.

6.2          We may offer special offers and/or discounted rates. Any special offers and discounted rates are subject to availability. Such offers and discounts cannot be applied to existing reservations.

6.3          We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date of your reservation, we will adjust the rate of VAT that you pay. We are not currently registered for VAT.

6.4          What happens if the price is wrong. It is always possible that, despite our best efforts, some of the reservation rates may be incorrectly priced. We will normally check prices before accepting your reservation so that, where the reservation's correct price is less than our stated price, we will charge the lower amount. If the reservation's correct price is higher than the price stated to you, we will contact you for your instructions before we accept your reservation.

6.5          When and how you must pay. We accept payment with the major credit/debit cards or bank transfer to HSBC 40-20-30 92029588. We ask for card details at the time of reservation to guarantee the booking and full payment is taken on departure. However, if you book three or four rooms for the same stay then we would ask for a 50% non-refundable deposit at the time of booking.

6.6 Electric Vehicle (EV) charging point. This is available for guests’ use only, for which there is a charge. Please let us know when you would like to use it so we can explain the best place to park.

7.            Cancellation

7.1          How to cancel up to 5 days before the arrival date. You may cancel your reservation up to 5 days prior to the arrival date selected by contacting us using the details on our Contact Us page and you will receive a full refund of any monies paid/card authorisation will be cancelled. Cancellations or amendments must be confirmed in writing both by you and us..

7.2          How to cancel within 5 days of the arrival date. If you need to cancel your reservation within 5 days prior to the arrival date, we charge up to 65% of the total cost for your reservation. Cancellations or amendments must be confirmed in writing both by you and us..

8.            Our responsibility for loss or damage suffered by you

8.1          We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the reservation process.

8.2          We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the services.

8.3          We are not liable for business losses. We only provide accommodation for private use. If you use the accommodation for any business or commercial purpose we will have no liability to you for any loss including; loss of profit, loss of business, business interruption, or loss of business opportunity.

9.            How we may use your personal information

How we may use your personal information. We will only use your personal information as set out in our Privacy Policy.

10.          Event Outside of Control

10.1       Failure to perform obligations due to an event outside of control. We shall not be in breach of these terms, nor liable for delay in performing, or failure to perform, any of our obligations under these terms if such delay or failure results from events outside our control. If the accommodation cannot be provided to you, we will inform you as soon as possible and a refund will be arranged.

10.2       Examples of events outside our control. An event outside of control includes, but is not limited to; strike, civil unrest, civil emergencies, government prohibition or restriction on all or part of the economy or trade, pandemic, epidemic, environmental disaster, utilities failure or interruption, adverse weather conditions (but only where The MET Office issues a severe weather warning).

11.          Other important terms

11.1       We may transfer this Agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will contact you to let you know if we plan to do this. If you are unhappy with the transfer you may contact us to end the contract within a month of us telling you about it.

11.2       You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

11.3       Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

11.4       If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11.5       Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

11.6       Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the services in the English courts. If you live in Scotland you can bring legal proceedings in respect of the services in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the services in either the Northern Irish or the English courts.
